Terms & Conditions
1. Introduction
-
These Terms and Conditions govern all orders placed through our website and any related services we provide.
-
By placing an order, you confirm you are at least 18 years old (or have appropriate consent) and agree to be bound by these Terms and Conditions.
2. Products and dietary information
-
We specialise in organic, raw vegan whole cakes and superfood balls and aim to clearly describe ingredients and any known allergens on our website and order pages.
-
As individual dietary needs and sensitivities vary, customers are responsible for reviewing ingredient information and seeking medical or nutritional advice where required.
3. Orders, pricing and payment
-
All products are made to order; orders are not confirmed until payment is successfully received and an order confirmation is issued.
-
Prices are listed in Australian dollars and may change from time to time, but the price applicable is the one displayed at checkout at the time you place your order.
-
We reserve the right to refuse or cancel an order (for example, in case of obvious errors, ingredient unavailability or suspected misuse), in which case any amounts paid for that order will be refunded.
4. Made‑to‑order production and lead times
-
Because items are prepared fresh to order, minimum lead times apply and are displayed on the website or during checkout.
-
Requested pickup times may be adjusted by us (for example, to meet production capacity or ingredient availability); any change will be communicated to you using the contact details provided at checkout.
5. Pickup only – no shipping
-
We do not offer postal or courier shipping; all orders must be collected in person from The Plant Organic Cafe and Market.
-
During checkout, you select a preferred pickup date and time window, and your order will be prepared for collection during that window.
6. Pickup process and risk
-
To collect your order, please arrive at The Plant Organic Cafe and Market within your nominated pickup window, advise the friendly staff that you are there to collect your order and provide your name (and order number if requested).
-
Risk and responsibility for the order pass to you once the order has been handed over at the cafe, including transport, storage and handling of the products.
7. Late, missed or incorrect pickups
-
If you believe you will be late or need to change your pickup time, contact us as early as possible; changes are subject to availability and cannot be guaranteed.
-
For perishable products, extended delays or failure to collect on the agreed date may affect quality and food safety; in such cases, refunds or remakes may not be available, and any accommodation will be at our discretion.
8. Cancellations and changes
-
Because items are made to order, cancellations and changes must usually be requested within a specified minimum notice period (for example, 48–72 hours before pickup for whole cakes), which will be stated on the website or order page.
-
If a cancellation or change is requested outside the required notice period, we may be unable to provide a refund or may charge a fee to cover costs already incurred (ingredients, preparation time, etc.).
9. Refunds and issues with your order
-
Consumer guarantees under Australian Consumer Law apply and cannot be excluded; you may be entitled to a repair, replacement or refund where goods are faulty or not as described.
-
If there is a problem with your order (for example, damage, incorrect item or quality concerns), please notify us as soon as possible, ideally at the time of pickup or within a reasonable period, providing photos and details.
-
Outcomes may include remake, partial refund, full refund or store credit, depending on the nature of the issue and your statutory rights.
10. Allergies, intolerances and health conditions
-
While care is taken when handling ingredients, our products may be prepared in environments that also handle common allergens; cross‑contamination cannot be ruled out.
-
You are responsible for ensuring that products are suitable for your dietary requirements and for notifying any intended consumers of ingredients and potential allergens; we are not liable for adverse reactions where ingredient information was provided and products were consumed contrary to medical advice.
11. Use of website and content
-
Content on the website, including text, images, branding and product descriptions, is provided for general information and marketing purposes and may change without notice.
-
You may not reproduce, distribute or use any content from the website for commercial purposes without our prior written permission.
12. Privacy
-
Your use of the website and ordering system is also governed by our Privacy Policy, which explains how we collect, use and protect personal information.
-
By placing an order or contacting us, you consent to the collection and handling of your personal information in accordance with that Privacy Policy.
13. Limitation of liability
-
To the extent permitted by law, our liability for any claim relating to the supply of products or services is limited, at our option, to resupplying the products or services, replacing the products, or refunding the amount paid.
-
Nothing in these Terms and Conditions limits or excludes any rights or remedies you have under Australian Consumer Law that cannot be limited or excluded.
14. Changes to these Terms and Conditions
-
We may update these Terms and Conditions from time to time to reflect changes in our business, products or legal requirements.
-
The version that applies to your order is the version displayed on the website at the time you place that order, so you should review these Terms and Conditions each time you order.
15. Governing law and contact
-
These Terms and Conditions are governed by the laws of the state or territory in Australia in which our business is based, and any disputes will be subject to the jurisdiction of the courts of that state or territory.
-
If you have questions or concerns about these Terms and Conditions, please contact us using the contact details provided on our website.
